Terms and conditions of sale - Online store

1. PURPOSE AND APPLICATION OF THE TERMS OF SALE

  1. This site is the property of Les Paillettes Vertes Sàrl.
  2. These terms and conditions govern the rights and obligations of the parties in connection with the online sale offered by Boutique Les Paillettes Vertes Sàrl.
  3. Each customer acknowledges having read, understood and accepted these GTC, without reservation.
  4. Les Paillettes Vertes Sàrl reserves the right to modify, at any time, these general terms and conditions of sale and to make them available on its website, effective as of March 1, 2019.

2. ORDERING AND ORDER PROCESSING

  1. All orders placed through the Online Shop are subject to an e-mail confirming receipt of the order, which includes all of the present General Terms and Conditions, as well as the items selected when the order was placed.
  2. The said e-mail suggests an indicative delivery date and Les Paillettes Vertes Sàrl cannot be held responsible for any delay in delivery, whatever the cause.
  3. The Customer’s attention is drawn to the fact that the products presented on the present website are for sale only within the limits of available stock and depending on the time of receipt of payment.
  4. Unless otherwise agreed, all confirmed orders are considered firm and the Customer may not withdraw from them once they have been confirmed.
  5. Any order from a customer with whom there is a dispute, for example concerning a payment obligation, will be refused, without the customer being able to claim any compensation.
  6. The computerized records of Paillettes Vertes are considered proof of communications, orders and payments between the parties.

3. INFORMATION ON PRODUCTS OFFERED FOR SALE

  1. The products proposed by Les Paillettes Vertes Sàrl constitute non-binding offers, valid while stocks last.
  2. In the event of unavailability of the product ordered, the buyer is informed and has the option of cancelling the order or requesting an exchange of the product. Les Paillettes Vertes Sàrl declines all responsibility for any damage suffered by a Customer as a result of any product being unavailable, undeliverable, out of stock or sold out.
  3. The items displayed on this website are sold while stocks last.
  4. Out-of-stock situations and replenishment lead times are mentioned wherever possible.
  5. The display of colors on the screen is not always accurate. Les Paillettes Vertes Sàrl does not guarantee that the color of the products corresponds exactly to the color displayed on the screen.
  6. Decorative items and accessories shown in a product photograph are not part of the product unless expressly included in the product description.
  7. As far as possible, Les Paillettes Vertes Sàrl endeavours to process orders within 3 to 5 working days.

4. PRICE AND PAYMENT

  1. The prices indicated on this site are in Swiss francs, including VAT. The prices indicated at the time of ordering are binding, but do not include shipping and packaging costs.
  2. Shipping and packaging costs are charged extra and are indicated at the end of the online order. The packaging and postal charges applied by Les Paillettes Vertes Sàrl are calculated for a postpac Economy package (www.post.ch). Customers’ attention is drawn to the fact that postal rates may vary at any time and that Les Paillettes Vertes Sàrl cannot be held responsible.
  3. If a product ordered is definitively no longer available or if Les Paillettes Vertes does not conclude the contract for any other reason, the payment made by the Customer will be refunded.
  4. Prices are subject to change at any time without notice. However, prices are determined at the time of order confirmation by the customer.
  5. Payment is made in advance online via TWINT, postfinance pay, credit card and your eco-participation points.
  6. All online credit card payments are processed on a secure server. The information concerned (e.g. credit card number and expiry date) is encrypted during transmission over the Internet.

5. ECO-PARTICIPATION POINTS

  1. Eco-participation points can be accumulated during purchases on the Paillettes Vertes website or during eco-participation actions on the Paillettes Vertes website.

  2. Each franc spent (excluding promotions) earns 1 point: CHF 1.00 spent = 1 point.

  3. Points accumulated can be converted and used for purchases over the next 12 months, except for points awarded on special occasions. 10 points have a value of 20 cts.

  4. Points accumulated cannot be used for delivery charges.

  5. Points for cancelled or refunded orders will be removed from the customer’s account.

  6. Partially paid orders or orders paid in points do not qualify for eco-participation points.

  7. The customer receives eco-participation bonus points of :
    25 eco-participation points for every 5 orders
    100 eco-participation points for every 500 points earned

  8. The following eco-participatory actions earn eco-participatory points:
    25 eco-participatory points for registering on our website, subscribing to our newsletter, sharing purchased products on social networks and posting a review of a purchased product
    250 points for sponsoring and purchasing new members

  9. Les Paillettes Vertes Sàrl reserves the right to grant eco-participation points to one or more users on special occasions. These points may have a different validity from the other points acquired in the points described in this section.

6. SHIPPING COSTS AND DELIVERY TIMES - DELIVERY / COLLECTION

  1. We deliver in Switzerland only.
  2. Delivery charges for all parcels up to 30 KG, including packaging, are :

  1. You can also opt for delivery against signature when you place your order, for an additional CHF 1.50.
  2. Orders are sent by post on receipt of payment, within 3 to 5 working days.
  3. We also offer the option of free collection of your orders from:
    Epicerie Saveurs en Vrac, Rue Pré-du-Marché 6, 1004 Lausanne
    When you place your order, you will need to select the “collection” option.
    Collection takes place according to their opening hours.

  4. Pick-up orders are processed weekly. Orders placed by Monday evening are available at the collection point from Wednesday.

  5. Orders must be collected within 15 days of notification of availability.

  6. Les Paillettes Vertes Sàrl declines all responsibility in the event of theft or loss of the parcel by the delivery service and no refund will be made. IF you live in an area at risk of parcel theft (large city or unattended building), we recommend the counter-signature delivery option.

  7. The Customer’s attention is drawn to the fact that data relating to delivery times are purely indicative, without binding effect and without guarantee on the part of Les Paillettes Vertes Sàrl. These data are subject to change without notice. Les Paillettes Vertes Sàrl cannot be held liable for any compensation in the event of delivery beyond the time indicated.

  8. The products ordered are sent to the address given by the Customer at the time of ordering.

7. DEFECTS

  1. The customer undertakes to check on receipt that the products delivered correspond to the order and are in good condition.
  2. Any complaint concerning all or part of the products delivered must be notified to Les Paillettes Vertes Sàrl in writing (by e-mail) within 5 working days of receipt at the latest.
  3. Products damaged in transit must be returned to Les Paillettes Vertes Sàrl. The customer agrees to notify Les Paillettes Vertes Sàrl, in writing (by email) of the damage found, within 5 days. Les Paillettes Vertes Sàrl will replace products damaged in transit free of charge.
  4. Les Paillettes Vertes Sàrl is responsible for the cost of returning products delivered by mistake or damaged in transit. Any other right of return is excluded except by prior agreement between the two parties.
  5. Subject to the cases defined in article 6.3 above, no product may be exchanged or returned.
  6. Les Paillettes Vertes Sàrl declines all responsibility for defects which the Customer has observed or could have observed upon receipt of the products and which he has not reported immediately upon discovery, in accordance with articles 6.1 and 6.2.
  7. Beyond defects noted on receipt, Les Paillettes Vertes Sàrl offers no warranty on the products sold.

8. DATA PROTECTION

  1. Subject to the provisions of these GTC, Les Paillettes Vertes Sàrl recognizes the confidentiality of data collected in connection with the conclusion of the contract. This data is collected, processed and used for the purpose of fulfilling the obligations arising from the sales contract. It is treated in the strictest confidence. This information will not be passed on to third parties. The customer consents to the storage by Les Paillettes Vertes Sàrl of the personal data provided in connection with the contractual relationship.
  2. The customer must register on the website with a login and password to place an order.
  3. The Customer guarantees the truthfulness and completeness of the data communicated by him to Les Paillettes Vertes Sàrl to obtain access to the online store respectively to place an order. He/she undertakes to update such information should it change.
  4. Les Paillettes Vertes Sàrl reserves the right to delete customer data at any time and without giving reasons, or to block a login and password.
  5. For further information on the management of personal data, the buyer is referred to the Privacy Policy defined in the Privacy Policy.
  6. Les Paillettes Vertes Sàrl reserves the right to send a newsletter, sms or mailing to its customers from time to time and to send them information on its new products.

9. GUARANTEE

  1. Any warranty offered to the purchaser shall be governed by Swiss law. Cases of force majeure are expressly reserved.

10. INTELLECTUAL PROPERTY

  1. Les Paillettes Vertes Sàrl is the sole holder of the copyright, in accordance with the applicable legal provisions, protecting the site and its contents, such as the logo, texts, elements, photos, graphics, etc.
  2. It is forbidden, without the prior written consent of Les Paillettes Vertes Sàrl, to copy, reproduce, download, use or publish the various contents of this website. Special links available for download are excluded.

11. MISCELLANEOUS

  1. Les Paillettes Vertes Sàrl cannot be held responsible for damages of any kind, whether material, immaterial or physical, which could result from the misuse or lack of care of the products sold. In particular, Les Paillettes Vertes Sàrl cannot guarantee that the products are suitable for the use intended by the Customer.
  2. The indications given in the product sheets, particularly concerning the properties of the products or their method of use, are given purely for information purposes and may in no case be considered as medical information, nor engage the responsibility of Les Paillettes Vertes Sàrl.

12. APPLICABLE LAW AND PLACE OF JURISDICTION

  1. These General Terms and Conditions govern the relationship between the Customer and Paillettes Vertes Sàrl. Beyond that, their relationship is governed by Swiss law, in particular the Swiss Code of Obligations, which regulates aspects not expressly mentioned in these GTC.
  2. In the event of a dispute, the Customer should first contact Les Paillettes Vertes Sàrl, in writing, in order to find an amicable solution.
  3. The place of jurisdiction is Lausanne (VD), Switzerland.
